AUSTIN, Texas — Following a catastrophic drunk driving crash, Texas-based personal injury firm Daniel Stark has successfully secured full insurance coverage to address their client’s life-altering spinal injury.
On Oct. 25, 2021, Daniel Stark’s client was traveling southbound on State Highway 130 in Travis County, Texas. The Defendant, who was driving the wrong way, collided head-on with the client’s vehicle. The impact caused the client’s vehicle to rollover and jackknife with the trailer he was towing, resulting in extensive property damage. The Defendant admitted to consuming alcohol prior to the crash, and a bottle of whiskey was discovered inside her vehicle at the scene.
Daniel Stark’s client sustained a lower spinal column fracture, which necessitated surgery almost a year later and requires ongoing medical attention. Upon initiating legal proceedings, the Defendant’s insurance carrier promptly paid their policy limits of $30,000. However, due to the Defendant’s limited coverage, Daniel Stark also pursued an underinsured claim through their client’s own auto insurance policy to fully compensate the client for his enduring pain. Initially, the client’s insurance provider offered a settlement amount of $170,000, which Daniel Stark deemed insufficient given the lasting impact of the drunk driving incident.
