AUSTIN, TEXAS — Texas-based plaintiff personal injury firm Daniel Stark has finalized an $850,000 settlement for a client who sustained a mild traumatic brain injury (TBI) following a rear-end collision in Austin.
During the incident, Daniel Stark’s client was rear-ended by the Defendant, who was driving a pickup truck for a landscape design company while attempting to merge onto the highway. The client lost consciousness at the crash site, underwent neck injections, and was facing chronic lifelong neck, back, and head pain.
“The issue was that our client’s brain MRI looked normal,” said Justin Jackson, the Daniel Stark attorney overseeing the case. “Even with her chronic head pain, it was tough to figure out what was wrong and what long-term medical care she would need, so we made sure she saw medical providers who were using cutting-edge technology for brain injuries.”
Medical assessments confirmed that the client experienced a TBI from the incident, which could heighten the client’s risk of dementia compared to individuals without a TBI history. The client’s loss of consciousness at the crash scene further amplified this dementia risk.
Initially, the insurance company offered settlements that didn’t exceed $20,000 for most of 2022 and 2023. However, a turning point occurred when the defense counsel’s medical expert testified that a person could suffer from a TBI even if their brain scans show no abnormalities. Daniel Stark’s legal team, along with qualified medical experts, presented evidence from the client’s daily life to prove to the insurance company that her mental capacity decreased after the wreck, despite the normal brain MRI results.
“It was a big moment when the opposing party’s TBI expert agreed with us. It ultimately helped us secure an $850,000 settlement to cover our client’s ongoing pain and future medical bills,” Jackson explained. “That’s exactly why our team is so thorough in getting our clients evaluated by doctors — we want to get them the support they need as they deal with the long-term impacts of a crash.”
